Update, October 31, 2004: this has been Identified as a Hammond's Flycatcher by some expert western birders.

This empid was found by Martin Reid and photographed by Jim Halff at the Halff Brothers Ranch, near Pearsall, Frio County, Texas on September 23 2004: in the field it was noted that the eye-ring was significantly expanded at the rear, and that it had a distinct, rather shaggy crest; it also flicked its wings and tail quite a lot - but note that this bird came in to an owl tape; it did call a few times when it first came in - a slightly disyllabic upslurred note:
